Please be advised that to the extent we contact you in connection with Constract Export-Import’ business operations, we process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, Official Journal of the EU L 119 of 04.05.2016) - hereinafter referred to as the Regulation.

1. Who is the controller of your personal data?

The administrator of your personal data is Constract Export-Import (hereinafter: Administrator, Constract Export-Import) with its registered office in Wałdyki, Wałdyki 23A, 14-229 Rożental, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000161989, NIP: 7441473866, REGON: 510693209, share capital: PLN 100,000.

2. How to contact the data controller?

You may contact us on matters related to the processing of your personal data by sending a letter to Constract Export-Import at the address indicated above or by sending an email to: brickwood@constract.pl.

3. For what purpose do we process your personal data?

Your personal data is processed for the purpose of conducting business by Constract Export-Import making sales of our products, concluding and executing agreements concluded by the Company, conducting contacts with customers, contractors and suppliers. The detailed scope of the personal data we process as well as the legal basis for its processing may vary depending on the purpose for which we process it:

Personal Data of Potential Customers and Contractors of Constract Export-Import

We process personal data of individuals who are potential customers of the Company as well as potential suppliers, subcontractors, contractors or service providers who may provide services to the Company in the future. In this case, the data processing process begins prior to the formal establishment of cooperation and includes the search for contractors, business discussions and negotiations or the preparation or submission of an offer. The data is processed for the purpose of establishing business cooperation and entering into a contract. If you fall into this group and it is you who comes up with the proposal to establish cooperation with the Company, the data is processed on the basis of the provision of Article 6(1)(b) of the Regulation, which states that the controller may process personal data, among other things, when it is necessary to take action at the request of the data subject before concluding a contract. If the initiative to conclude a contract and start business cooperation comes from Constract Export-Import, we process your personal data on the basis of the provision of Article 6(1)(f) of the Regulation, which says that the controller may process data when it is necessary for the realization of legitimate interests of the controller. Establishing cooperation with clients, contractors, suppliers, subcontractors, service providers or contractors is just such a legitimate interest of the Company.

Personal data of the Company's Clients and Contractors

We process personal data of our Customers and Contractors with whom we work - such as individuals who purchase our products or services, contractors' suppliers, service providers who provide services to the Company, or subcontractors. If you are a person from this group, the processing of your personal data is based on the provision of Article 6(1)(b) of the Regulation, which states that we may process personal data if it is necessary for the performance of a contract to which the data subject is a party.

In addition, we may process personal data of our Customers or Contractors for purposes related to the fulfillment of obligations imposed on the Company by law, such as tax law. In such case, the processing of personal data shall be based on the provisions of Article 6(1)(c) of the Regulation.

In some cases, we may process your personal data in order to realize the Company's legitimate interests, such as the assertion of claims or defense against claims. In this case, the basis for processing your personal data is the provision of Article 6(1)(f) of the Regulation, which indicates the possibility of processing your data when it is necessary for the realization of the legitimate interests of the controller.

Personal data of employees and associates of the Company's Clients or Contractors

We also process personal data of employees or collaborators of our Clients and Contractors (suppliers, service providers, contractors, subcontractors), as well as potential Clients or Contractors. This includes, for example, the data of employees of companies with whom we are in contractual discussions, are bound by contracts or trade. If you are such a person, we would like to inform you that your personal data is processed for the purpose of establishing cooperation with your employer or principal, or for the performance of the agreement concluded between them and the Company. This constitutes a legitimate interest of Constract Export-Import and the processing of data takes place on the basis of the provision of Article 6(1)(f) of the Regulation, which indicates the possibility of processing data in a situation where it is necessary for the realization of the legitimate interests of the administrator.

 

4. Where do we get your personal data from and what categories of data do we process?

We obtain personal data of clients or customers (including potential clients) directly from these individuals or from publicly available sources, such as the website for your business. This data may include identification data, contact data, data on business cooperation conducted and data on financial settlements.

Data of employees of entities with which Constract Export-Import cooperates, i.e. employees of clients/contractors, includes identification data, contact data and data about the place of work. We obtained them directly from you or your employer.

 

5. How long will your personal data be processed?

Your personal data will be processed for the following period of time:

Data processed for the purpose of commercial negotiations, making offers, etc.

In the case where negotiations are conducted for the conclusion of an agreement with the Company - for the duration of these talks and for up to one year from the date of their completion, whereby in the situation where cooperation with the Company is established, they will be processed in accordance with the provision indicated in paragraph 4 B.

Data processed in case of business cooperation

If you are a party to a contract concluded with the Company - for the duration of the contract and until the expiration of the statute of limitations for claims arising therefrom, generally 3 years after the end of cooperation. Data in the field of financial settlements are kept for a period of 5 years from the end of the fiscal year in which accounting documents were issued or financial operations were carried out, in accordance with the content of tax regulations.

Data of employees of Customers or Contractors

If you are an employee or collaborator of our Client or Contractor, we will process your personal data for the duration of your cooperation with the respective Client or Contractor and until the expiration of the statute of limitations for claims arising from such cooperation, generally 3 years after the end of cooperation.

 

6. To whom may your personal data be transferred?

Your personal data may be transferred to third parties, such as:

  • provider of email hosting services for the Company,
  • entities providing the Administrator with consulting, auditing, legal assistance or tax and accounting assistance,
  • entities providing postal or courier services.

 

7. What rights do you have, related to the processing of personal data?

You have the right to:

  • to access and correct your personal data,
  • demand restriction of the processing of your data,
  • request deletion of your personal data,
  • to request the transfer of your personal data,
  • to the extent that your data is processed on the basis of the legitimate interests of the controller - to object to the processing of your personal data.

In addition, if you consider that your personal data is being processed unlawfully, you have the right to file a complaint with a supervisory authority.

 

8. Other information

Refusal to provide data may result in inability to conclude or execute a contract with the Company.
Please be informed that your data will not be processed in an automated manner, including not used for profiling.
